Welcome to Memsaab, a New Zealand-based store offering women’s Indian clothing. By using our website, you accept these Terms & Conditions. If you disagree with any part, please don’t use the website. Nothing in these terms limits your rights under the New Zealand Consumer Guarantees Act or Fair Trading Act.

1. Definitions

  • “Memsaab” — our business, including staff and representatives.
  • “Website” — Memsaab’s online store.
  • “Customer” — anyone who uses or purchases from the website.
  • “Products” — women’s Indian clothing and related accessories sold on the website.

2. General

  • 2.1 Age: By using the website you confirm you’re at least 18, or of legal age to enter a binding agreement in your location.
  • 2.2 Regions: We currently ship to New Zealand, Australia, and Fiji. Orders from other regions may not be accepted.
  • 2.3 Amendments: We may update these terms at any time. The version in effect when you order applies to that order.
  • 2.4 Right to refuse: We may refuse service or cancel orders where an order breaches these terms or the law, or appears fraudulent.

3. Ordering & Payment

  • 3.1 Accurate details: Please provide complete, accurate personal and delivery information.
  • 3.2 Acceptance: All orders are subject to availability and acceptance. Because we typically hold one piece per size, an item may sell out; if we can’t fulfil an order we’ll refund it in full.
  • 3.3 Pricing: Prices are shown in NZD (or AUD where applicable) and may change without notice. Shipping and any applicable taxes are shown at checkout.
  • 3.4 Payment: Full payment is required at purchase. We use a secure payment provider and don’t store full card details.

4. Shipping & Delivery

Shipping methods, costs, and timeframes are set out in our Shipping Policy, which forms part of these terms. Customers are responsible for any customs duties or import charges on international orders. Please report damaged or missing parcels within 7 days of the recorded delivery date, in line with our Shipping Policy.

5. Returns, Exchanges & Final Sale

  • 5.1 Change-of-mind returns are handled under our Returns & Exchange Policy: notify us within 5 days of delivery, item unworn with tags intact.
  • 5.2 Final sale: Items bought on sale or marked final sale can’t be returned or exchanged for change of mind.
  • 5.3 These limits apply to change-of-mind only and don’t affect your rights for faulty or misdescribed goods.

6. Intellectual Property

  • 6.1 Memsaab owns its website content, design, logos, and trademarks.
  • 6.2 You may not reproduce, distribute, or modify our content without permission.

7. Liability

  • 7.1 To the extent permitted by law, Memsaab isn’t liable for indirect or consequential losses arising from use of the website.
  • 7.2 Where liability can lawfully be limited, it’s limited to the amount you paid for the relevant product.
Your consumer rights: Nothing in this section excludes or limits the guarantees you have under the New Zealand Consumer Guarantees Act or your rights under the Fair Trading Act. These apply regardless of anything stated here.

8. Governing Law

  • 8.1 These terms are governed by the laws of New Zealand, and disputes fall under the jurisdiction of New Zealand courts.

9. Severability & Entire Agreement

If any provision is found invalid, the rest remain in effect. Together with our Shipping and Privacy policies, these terms form the entire agreement between you and Memsaab.
